Ran up to Duluth and got some Smelt... They are starting to run now. Came back with allot to eat and enough bait for the year. They seem to average 3-5 inches with a few jumbos at 6-10 inches. Also we where catching a few Lakers in the nets which we did release ( its the Law-DARN). Had a fun time but had to work for them. Now is the time to head up if your into Smelt. The Water temps are flexing from 38-42 degrees which is about perfect for the run. Good luck! Mark

The only places you can use Lake Superior Smelt as bait is Lake Superior and its tributaries because of the invasive species problems in Lake Superior. So don't plan on using those anywhere else.

I'm pretty sure that that just means you can't take live smelt for bait, you have to freeze or brine them.

Subp. 5.
Prohibition on taking fish for bait purposes.

The taking of fish for bait purposes from all Minnesota waters of Lake Superior and all waters of the St. Louis River downstream of the Fond du Lac Dam in St. Louis and Carlton Counties, including any and all outflows, estuaries, streams, creeks, or waters adjacent to or flowing into these waters is prohibited.

I know you can't even use even DEAD smelt in at least parts of if not all of Ontario.

The part where it says "for bait purposes" is implying live bait. All the bait shops that sell frozen smelt harvest them from the big lake.

As for Canada, apparently they believe that smelt eggs remain viable even after being frozen.

that is wrong. contact your area fisheries manager to confirm that.

Subp. 4.
Taking smelt from Lake Superior.

Smelt may be taken by licensed anglers from Lake Superior and tributary streams subject to the following provisions:
A.

smelt may be taken with the use of dip nets and minnow seines not more than 25 feet in length nor more than four feet in depth. Seines may not be used in any stream, except the St. Louis River, and seines may not be used in Lake Superior within 100 feet of the mouth of any stream;
B.

live smelt may not be possessed or transported; and
C.

taking of smelt at any time is prohibited in the following streams tributary to Lake Superior:
(1)

French River, St. Louis County;
(2)

Sucker River, St. Louis County;
(3)

Little Sucker River, St. Louis County;
(4)

Silver Creek, Lake County;
(5)

Encampment River, Lake County; and
(6)

Crow Creek, Lake County.
Subp. 5.
Prohibition on taking fish for bait purposes.

The taking of fish for bait purposes from all Minnesota waters of Lake Superior and all waters of the St. Louis River downstream of the Fond du Lac Dam in St. Louis and Carlton Counties, including any and all outflows, estuaries, streams, creeks, or waters adjacent to or flowing into these waters is prohibited.

notice that subpart 4. - B.
addresses handling live smelt. that has been a law for many moons.

the subpart 5. is new and addresses using lake superior smelt for bait.

it does not say it's ok to use them if frozen, or salted, or preserved in any manor for that matter.

This isn't gonna turn into one of those heated name calling debates is it?

Before anyone else throws in a heated remark, I thought it was a good report with good information, let's not go WAY off track here.
This may be something to take a look at to find out EXACTLY, not what anyone THINKS, but EXACTLY what they mean by this.
I for one find it hard to believe that they would not allow people to use them if they are indeed dead. What are all the jack fishermen on LOW gonna use now!?
